If You Are Arrested:
- Do not panic, do not become verbally abusive, and most of all, do not become physically assaultive, as this behavior will only add to the charges you are already facing.
- You have the right to remain silent, and anything that you say can and will be used against you in court. Do not assume that you will be able to talk your way free, or that the signing of a statement will get you released. Chances are that remaining silent does not mean you should not give your name and identification to the officers.
- You are entitled to make a telephone call to either a family member or a lawyer, if you already have one. Be aware, however, that whatever you say in front of police officers, even if you are on the telephone with your attorney or family, can be used against you. If it is family that you are speaking to, tell them where you are and to call an attorney for you. If you have called Mr. Naiburg directly, he will advise the officer to cease questioning you, and will have ascertained the nature of the charges against you. He will then speak to you to ask you who you would like him to contact on your behalf.
